Acceptable Use Policy
Effective July 2, 2026
MailPanda is an email service provider (“ESP”) for e-commerce brands. Every email you send through our platform reflects on MailPanda’s shared sending reputation — and on the deliverability of every other merchant we serve. This Acceptable Use Policy (“AUP”) sets the rules that keep our network trustworthy for everyone.
By using MailPanda, you agree to this AUP. Violations may result in immediate suspension or termination of your account without refund. This policy is incorporated into our Terms of Service.
The golden rule: permission-based sending only
You may only send to recipients who have given clear, affirmative consent to receive marketing email from you. This means:
- Opt-in required. Recipients must have actively subscribed — by checking a box, entering their email in a signup form, or completing a purchase with a visible disclosure that they will receive marketing emails. Pre-checked boxes do not count.
- No purchased, rented, or scraped lists. You may not import contacts obtained through list purchases, data brokers, web scraping, or any method other than direct, voluntary opt-in to your brand.
- No co-registration unless disclosed. If you collected addresses through a partner or giveaway, recipients must have been clearly told they would receive email from your brand specifically — not just “partner offers.”
- Honor unsubscribes immediately. When someone clicks unsubscribe, they must be removed from marketing sends within the timeframe required by law (10 business days in the US, immediately in many other jurisdictions). MailPanda handles this automatically for emails sent through our system.
Prohibited content & senders
The following are strictly prohibited on MailPanda. We will suspend or terminate any account found to be involved in:
Illegal or harmful content
- Content that violates any applicable law, regulation, or third-party right.
- Phishing, malware distribution, or any attempt to deceive recipients into revealing credentials or personal information.
- Fraudulent offers, pyramid schemes, or “get rich quick” promotions.
- Threats, harassment, hate speech, or content promoting violence.
- Content that exploits or endangers minors.
Prohibited industries
MailPanda does not support senders in the following categories, regardless of legality in your jurisdiction:
- Illegal products or services— including controlled substances, unlicensed pharmaceuticals, and counterfeit goods.
- Adult content— pornography, escort services, or sexually explicit material.
- Gambling— online casinos, sports betting, or similar wagering services (licensed lotteries may be exceptions with prior approval).
- Weapons & ammunition— firearms, explosives, or related accessories.
- Cryptocurrency & high-risk financial services— ICOs, unregistered securities, payday lending, or debt collection.
- Multi-level marketing (MLM)— network marketing or referral-based sales schemes.
- Affiliate marketing spam— bulk promotion of third-party products without a genuine relationship to the brand.

Deceptive practices
- Misleading subject lines, sender names, or “From” addresses that disguise the true sender.
- Impersonating another brand, organization, or individual.
- False or exaggerated claims about products, pricing, or availability.
- Hidden or hard-to-find unsubscribe mechanisms.
Technical requirements
- Valid sender identity. You must use a verified sending domain and accurate sender information. Emails must include a valid physical mailing address as required by CAN-SPAM and similar laws.
- Working unsubscribe. Every marketing email must contain a clear, functioning unsubscribe link. MailPanda inserts one automatically; do not remove or obscure it.
- Clean list hygiene. Remove hard bounces promptly. Do not re-import addresses that have previously bounced or unsubscribed. High bounce or complaint rates may trigger automatic sending limits or account review.
- No unauthorized automation. Do not attempt to bypass rate limits, abuse APIs, or automate actions in ways that harm our infrastructure or other users.
Compliance with laws
You are responsible for ensuring your email program complies with all applicable laws, including but not limited to:
- CAN-SPAM Act (United States)
- CASL (Canada)
- GDPR (European Union and EEA)
- PECR (United Kingdom)
- Spam Act 2003 (Australia)
- Any other national or regional anti-spam or data protection regulations.
MailPanda provides tools (unsubscribe handling, consent tracking, suppression lists) to help you comply, but compliance is ultimately your responsibility.
Monitoring & enforcement
We monitor sending patterns, complaint rates, bounce rates, and spam-trap hits to protect our network. If we detect a potential violation, we may:
- Request documentation of consent for your list.
- Temporarily throttle or pause your sending while we investigate.
- Suspend your account immediately for severe or repeat violations.
- Terminate your account without refund.
We try to work with good-faith senders to resolve issues, but we reserve the right to act unilaterally to protect our platform and other users.
Reporting abuse
If you receive unwanted email sent through MailPanda, or if you believe a MailPanda customer is violating this policy, please report it to abuse@mailpanda.ai. Include the full email headers and any relevant details. We investigate every report.
Changes to this policy
We may update this Acceptable Use Policy from time to time. We will post the revised policy here and update the effective date. Material changes may also be communicated by email or in-product notice. Continued use of the Service after changes constitutes acceptance.
